Privacy Policy & Terms of Use

Last updated: October 30, 2026

These Terms of Use and Privacy Policy govern your access to Whisly, a voice-story community. Please read both documents before registering. Select I Agree to proceed to registration, or I Do Not Agree to leave Whisly.

General legal terms; mandatory rights under applicable law always apply. These documents should be reviewed by qualified legal counsel before commercial launch.

Terms of Use

1. Acceptance and scope

By selecting I Agree and using Whisly, you accept these Terms and acknowledge the Privacy Policy. If you disagree, do not register or use the service. Additional clearly disclosed terms may apply to particular paid features. These Terms do not waive mandatory consumer or privacy rights.

2. Eligibility and account registration

You must be legally able to enter this agreement and meet the minimum age requirements of your country. If you are not legally able to consent independently, do not register without any legally required parent or guardian authorization. Paid features are only for users legally entitled to make the purchase. Provide accurate registration information, including your name, email, and country, and keep it current. Do not impersonate anyone or create an account for another person without permission.

3. Account security

Keep your password and sign-in credentials confidential. You are responsible for activity you authorize on your account. Notify us promptly of suspected unauthorized access. Do not share or sell accounts, circumvent access controls, or access another user's account. We may restrict compromised accounts while investigating. You remain free to use any account recovery methods the service provides.

4. The service and feature availability

Whisly lets users record, publish, and listen to voice stories. Recordings are limited to five minutes, and the feed is scoped to the country in your profile. Features may vary by location, account, device, or release. Current features include voice stories, a country feed, likes, saves, credits, notifications, and private messaging. Internet, device, and mobile-data charges are your responsibility. User stories are personal expression, not professional medical, legal, financial, or emergency advice.

5. Community conduct and prohibited content

Do not publish illegal content, threats, harassment, hate speech, sexual exploitation, material involving abuse of children, encouragement of violence or self-harm, scams, spam, or content that infringes others' rights. Do not disclose private information, record people without the consent required by law, impersonate others, manipulate engagement, distribute malware, scrape restricted data, or disrupt the service. Respect other users' dignity and privacy. In an emergency, contact local emergency services rather than relying on Whisly.

6. Your content and permissions

You retain ownership of your original stories. By uploading content, you grant Whisly a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display or play that content only as needed to operate, secure, and provide the service. You confirm that you own or have permission to use all recorded voices, music, and other material. This license ends when content is deleted, except for reasonable backup retention, legal preservation, and copies already shared independently by others. Sharing is not a guarantee of anonymity or confidentiality; listeners may identify your voice or capture your story.

7. Reporting, moderation and objections

We may review reports and restrict or remove content or accounts where reasonably necessary to enforce these Terms, protect users, or comply with law. We do not guarantee review of every story before publication. To report abuse, infringement, or object to a decision, email the contact below with the relevant story or account, the reason, and supporting information. For intellectual-property complaints, identify the protected work, disputed material, your authority to act, and accurate contact details. We may request further information and will consider objections subject to applicable law.

8. Purchases, memberships, credits and gifts

Only features available in the current checkout can be purchased. Before payment, review the price, currency, taxes where applicable, duration, benefits, and any renewal terms. No recurring charge is authorized unless expressly disclosed and accepted. Payment processing is performed by the payment provider shown at checkout under its own terms. A payment is completed only after server verification. If credits or virtual gifts become available, their pack price and permitted use must be disclosed before purchase; they are not legal tender, bank deposits, investments, or a promise of cash redemption. Creator support is currently tracked through the merchant payment flow and does not itself guarantee a cash payout to a creator. Do not purchase assuming an undisclosed payout, conversion rate, or future feature.

9. Refunds and payment disputes

For duplicate, incorrect, unauthorized, or failed purchases, contact us with the transaction reference, without sending card details. Refunds, cancellations, withdrawal rights, and any exceptions for digital services are governed by applicable law and the terms disclosed at checkout. Nothing here excludes statutory refunds or consumer remedies. Refund processing may depend on the payment provider. We may investigate disputed or fraudulent transactions, but legitimate complaints and statutory rights remain protected.

10. Whisly intellectual property and third parties

Whisly's branding, interface, and software are protected by intellectual-property law. You receive a limited right to use the service, not ownership of these materials. Do not reproduce or distribute them without permission except where law allows. Third-party sign-in, payment services, advertisements, or external links are governed by their providers' terms. A link or advertisement is not an endorsement. We are not responsible for independent third-party services beyond obligations imposed by law.

11. Suspension, deletion and termination

You may stop using Whisly at any time and request account deletion through the contact email. We may suspend or terminate access for serious or repeated violations, fraud, security risks, or legal obligations, using proportionate measures and notice where appropriate and legally required. Termination does not remove rights to statutory remedies or erase records that must lawfully be retained. Obligations that by their nature survive termination, including payment obligations already incurred and protection of rights, continue to apply.

12. Availability, disclaimers and liability

We take reasonable steps to operate Whisly securely, but cannot promise uninterrupted access, error-free operation, or the accuracy of user content. To the extent permitted by law, the service is provided as available, and we are not liable for indirect losses arising from use of the service. Nothing excludes liability for fraud, deliberate misconduct, gross negligence where it cannot be excluded, death or injury caused by negligence, or any other liability or consumer right that the law does not allow us to exclude. You remain responsible for your unlawful conduct, without limiting protections you have under applicable law.

13. Changes, applicable law and disputes

We may update these Terms as the service or law changes, showing the revised date and providing notice of material changes where required. Material changes requiring consent will not be imposed retroactively without that consent. Contact us first to try to resolve a dispute. Applicable law, courts, and mandatory consumer protections are determined under the laws that apply to you and the service operator; these Terms do not force arbitration, select an undisclosed jurisdiction, or remove your right to approach a competent court or regulator. If a provision is unenforceable, the remaining provisions continue to apply.

14. Messaging

Private messaging is an active Whisly feature. The content rules in these Terms apply to messages as well as stories. Do not use messages for spam, harassment, scams, or unsolicited promotion. We may restrict messaging for accounts that break these rules.

Privacy Policy

1. Scope and responsibility

This Policy explains how personal information is used in operating Whisly. Whisly is responsible for its own handling of your information; independent sign-in and payment providers are responsible for their own processing. For questions about the responsible operator, your data, or your rights, use the contact email below.

2. Information we collect

Account information includes your account identifier, display name, email, country, and sign-in details processed through our authentication provider. If you use Google sign-in, we receive the profile and account information authorized by that flow, not your Google password. We store voice recordings, titles, categories, publication details, likes, saved stories, plays, reports, and membership or payment records needed for available features. Technical information such as IP address, device/browser information, timestamps, and error or security logs may be processed to deliver and protect the service. Correspondence sent to us is also processed. If messaging or other features are introduced, their data practices will be disclosed before use.

3. Microphone and sensitive information

Microphone access requires your device or browser permission and is used for recordings you initiate. You may revoke permission through device or browser settings. Publishing sends your recording to storage and makes it available to eligible listeners. A voice recording may contain personal or sensitive information about you or others; share only what you are authorized and comfortable to disclose. Whisly does not need sensitive personal details for ordinary registration. We do not describe voice uploads as biometric identification; any future identification use would require separate disclosure and any legally required consent.

4. Purposes and legal grounds

We use information to create and secure accounts, show country-relevant stories, host and play recordings, record interactions, process verified purchases, respond to requests, investigate abuse, and meet legal obligations. Where applicable, legal grounds include performance of the service agreement, legitimate interests in security and service operation balanced against your rights, compliance with law, and consent where required. Microphone permission or acceptance of these Terms does not constitute blanket consent for unrelated advertising or sensitive-data processing. You may withdraw consent-based processing without affecting its previous lawfulness.

5. Who can see information and service providers

Your display name, published voice stories, and associated engagement information can be visible to authorized users under the app's access rules; stories are generally limited to your country and your own account. Country filtering and private storage are access controls, not a guarantee that listeners cannot copy or share information. We use Lovable Cloud for hosting, authentication, database services, and file storage, Google for optional sign-in, and PayPal for available payments. These providers process the data necessary for their services. Full payment credentials are handled by the payment provider rather than stored by Whisly. Information may also be disclosed when legally required, to protect rights and safety, or in a lawful business transfer subject to appropriate safeguards. We do not sell your voice recordings; any materially different data use would require an updated disclosure and consent where required.

6. Cookies, browser storage and advertising

Authentication cookies or equivalent browser storage keep you signed in, and local storage remembers your selected language. These necessary functions are different from advertising tracking. Sponsored placeholders alone do not establish that an ad network is active. If non-essential analytics or personalized advertising are introduced, we will disclose the providers and seek consent where required before activating relevant tracking. You can manage browser storage in your browser settings; clearing it may sign you out or reset preferences.

7. Retention and deletion

We retain information only for as long as reasonably necessary for the purposes described, including maintaining your account and published stories, resolving disputes, fraud prevention, and legal accounting obligations. Retention varies by data category and applicable law; no indefinite retention is intended. You can delete your own stories using available controls and request account deletion by email. Deleted data may persist temporarily in protected backups, and records subject to a legal requirement or hold may be retained. Copies made independently by listeners or third-party services may not be removable by Whisly.

8. Security and international processing

Whisly uses authentication, access restrictions, private audio storage, time-limited playback links, and server-side payment verification to reduce unauthorized access. No internet service can guarantee absolute security. Keep your credentials private and report suspected incidents. Service providers may process information in countries other than yours. Where international-transfer rules apply, legally required safeguards and information will be provided; contact us to ask about the safeguards applicable to your data.

9. Your privacy rights and choices

Depending on applicable law, you may request access, correction, deletion, a portable copy, restriction of processing, or object to certain processing, including processing based on legitimate interests. You may withdraw consent where processing relies on it and complain to your competent data-protection authority. Send requests or objections to the contact email. We may verify your identity proportionately before acting and will respond within applicable legal deadlines. Rights can have lawful exceptions, which will be explained where applicable. Changing your country changes the feed; it does not change your legal rights or guarantee relocation of stored data.

10. Children, updates and contact

Whisly is not directed at children below the lawful minimum age for independent use in their country. If you believe a child has provided information without required authorization, contact us so we can investigate and take appropriate action. We may update this Policy and will show the revision date, notify users of significant changes where required, and request fresh consent where necessary. All privacy questions, complaints, and objections use the contact email below.

11. Unpublished and published recordings

Unpublished recordings are private. While you record, listen back, delete or re-record, the audio stays on your own device and is not uploaded; no other member can listen to it, and you can delete it at any time with the Delete button. A recording is uploaded only when you choose Publish and confirm. Once you publish a story it becomes available for listening to signed-in Whisly members in the country set on your profile, under the app's access rules, and its title, category, and engagement counts are visible to them. Published audio is stored in private storage and played through time-limited links, but listeners could still record or share what they hear. You can delete your published stories at any time from the story's menu; deletion removes the story from the feed and storage, although copies made by others, backups retained for a limited period, or records we must keep by law may not be removed immediately.

12. Private messages

Whisly includes private one-to-one messaging between members. Messages are visible only to the sender and the recipient and to systems required to deliver and secure the service; we may review reported messages to investigate abuse. You are responsible for what you send. Do not share passwords, payment details, or information you are not authorized to share, and report harassment through the contact below.

Contact & requests

All inquiries, complaints, objections, privacy requests, partnership proposals, and collaboration requests must be sent to the email below. Include enough detail to help us respond, but never send passwords, payment credentials, or sensitive identity documents unless specifically requested through a secure process.
